Who pays when a delivery driver causes a crash?

E-commerce has given rise to significantly higher levels of at-home deliveries. Numerous companies have their own proprietary delivery fleets. The existing parcel delivery services now have much busier schedules and larger fleets than they did a few decades ago. 

There are delivery drivers operating commercial delivery vans, as well as numerous professionals driving smaller passenger vehicles for on-demand delivery of groceries and other goods. Delivery drivers either get paid by the trip or have intense daily schedules. 

Delivery drivers may maneuver aggressively, become distracted while driving or park in unsafe places. Their choices in traffic may lead to collisions. What types of compensation are available after a collision caused by a delivery vehicle? 

Commercial insurance may be available

Companies generally carry specialized insurance on delivery vehicles. People injured by fleet vehicle crashes may have the option of filing a claim against a commercial insurance policy. Those policies are often larger than the coverage available through passenger vehicle liability insurance. 

Even with bigger policies, insurance may not be enough to pay for all of the losses sustained in a crash. When there are substantial losses, people may need to pursue personal injury litigation. Occasionally, the driver is directly responsible. 

Frequently, their employer might be liable. Vicarious liability may make businesses financially and legally culpable for negligent behavior by workers while they are on the clock. People hurt by delivery vehicles can therefore pursue relief via personal injury lawsuits without worrying about causing financial devastation for the delivery driver in particular.
