I just got into an accident with an uninsured driver; now what?

On Behalf of Pheffer Law | Nov 27, 2024 | Motor Vehicle Accidents

One moment, you’re cruising down the highway, music playing and lost in thought about your day. The next, your world turns upside down in a screech of tires and crunch of metal. Car accidents strike without warning, leaving you shaken and disoriented. But the shock of the crash is just the beginning.

When you discover the other driver has no insurance, a wave of anxiety washes over you. How will you pay for repairs? Who will cover your medical bills? In California, where insurance is mandatory, this situation feels like a nightmare. But don’t panic – you have options and understanding them is your first step toward recovery.

Steps to take right after the crash

Quick action can make a big difference in protecting your rights. After ensuring everyone’s safety and calling the police, take these important steps to safeguard your interests:

  • Get information: Write down the other driver’s name, phone number and car details. Ask witnesses what they saw.
  • Take pictures: Snap photos of the damage, any injuries and the accident scene.
  • See a doctor: Go to the hospital or your doctor, even if you feel fine. Some injuries take time to show up.
  • Call your insurance: Tell them about the crash and ask what your policy covers.

Staying calm and collecting information can really help your case later. Once you’ve done these things, you can start looking into how to get compensated.

Pursuing fair compensation

When the other driver has no insurance, you need to look at other options to cover your costs. Your choices depend on your own insurance and what happened in the crash.

Check if you have Uninsured Motorist coverage in your auto policy. This can pay for your medical bills, lost wages and other expenses. If you don’t have this coverage, you might still have options:

  • Use your own collision coverage
  • Sue the uninsured driver
  • Look into California’s Assigned Risk Plan

Talking to a lawyer who knows about car accidents can help you figure out your best move.

Dealing with an uninsured driver crash is tough, but you’re not out of luck. By taking the right steps and exploring all your options, you can protect yourself and work towards getting fair compensation.
